Project that creates a registry of sexual offenders approved in the last debate

The bill that creates the registry of sexual offenders was approved by the Plenary with 40 votes in favor, 0 against and 0 abstentions.
The Plenary of the National Assembly (AN) approved in the third and last debate the bill No. 51, through which the National System of Official Registry of Sex Offenders is created.

The legislative initiative was approved with 40 votes in favor, 0 against and 0 abstentions.

The registry of sexual offenders will contain information on the people who are convicted, by means of an enforceable sentence, for crimes against sexual freedom and integrity to the detriment of minors , in order to serve as a consultation database for justice operators.

According to this bill, the registry of sexual offenders would be in charge of the Cabinet of Archives and Personal Identification of the Directorate of Judicial Investigation, which must maintain an updated database stored in a secure and confidential environment.

The database will contain the following information on people convicted of crimes against sexual freedom and integrity: full name and nickname, date of birth, parents' name, place of birth, ID or passport number, address, photographs and fingerprints fingerprints.

Also the final conviction issued in the respective case and the resolutions issued by the Compliance Judge during the execution of the sentence.

The Compliance Judge or judicial office of the Judicial Branch must send within 30 days to the Archives and Identification Cabinet the updated data of the persons who have been convicted of committing crimes against sexual freedom and integrity to the detriment of minors under age.

While the Directorate of the Penitentiary System must send the updated sentencing order of those convicted and who continue to serve sentences imposed in the country's prisons, for crimes against freedom and sexual integrity to the detriment of minors.

This may be consulted by public and private entities, in order to define the suitability of people who hold positions in which there is interaction with minors.

To access the information of the National System of Registration and Official Consultation of Sex Offenders of minors, a written request must be made or through the website, which provides certainty of the identity of the applicant and the documents that prove the purpose of said request.

"It is very good for the population because with this you can know who is entering your neighborhood, your community. A limit is being established for people who have been penalized for crimes against sexual freedom, who cannot be so many meters away of schools and places where we have minors," said deputy deputy Walkiria Chandler about the project that creates the registry of sexual offenders.

Chandler indicated that there will be a biometric DNA record and a sex offender certificate is being considered for certain jobs and sensitive positions.
