Panama Colón Container Port fails to comply with investment plan and payment of royalties to the State

The Comptroller's Office reported that the audit of contract A-2017-12 of May 17, 2013 showed non-compliance with the basic contractual obligations.
An audit by the Comptroller General of the Republic of Panama revealed that Panama Colon Container Ports has breached its law contract with the State by 83.4%.

The auditing entity detailed that the third-investment clause established an amount of $593,962,330 of which B$300,900,000 correspond to the construction of three piers and $293,062,330 related to other activities.

To date, according to the field inspection of the National Engineering Directorate of the Comptroller General of the Republic and documentation provided by the Panama Maritime Authority (AMP), it has been verified that the company's real investment is estimated at $104,203,183.70, which represents only 16.6% of the total investment or a default of 83.4%.

The audit also revealed that regarding the fourth-fee clause and rates, as of April 2021 Panama Colon Container Ports had to pay $2,858,019.71 as payment for each square meter of seabed granted in concession, however, To date, the Panamanian State has only received $1,845,100.54, maintaining an outstanding balance of $1,012,919.17, which represents 35.4%.

The last payment evidenced by the company corresponds to the billing of December 2018.

In addition, indicated the Comptroller General of the Republic, this non-compliance has caused the State to stop receiving the fee for container movement and its income tax, dockside, anchoring, lighthouses and bollas.

On the other hand, the twelfth clause related to jobs, by which Panama Colon Container Ports was obliged to hire at least 800 direct jobs to Panamanian citizens in the construction phase that should have already concluded, has been breached since there is only an estimate of labor relations with 355 people, which represents a 55.6% non-compliance.

Failure to comply with the obligation to start operations completely as of June makes it impossible to create jobs in the operational part that projected 1,000 labor contracts.

The Office of the Comptroller General of the Republic indicated that the audits of port operations concessionaires seek to guarantee compliance with their obligations to the State.
